u St. Vincent chief medical officer Gary Frank told Goldstein “all vascular referrals would be sent to him, as he would be the only vascular and thoracic surgeon in Santa Fe,” but other surgeons took many of the available vascular cases.

u Goldstein was promised ample access to the operating room, a surgical assistant and coverage for vacations and some weekends but did not get adequate access, got only a physician’s assistant a year and a half into his contract and had to work weekends and take only limited vacations.

u In early January of this year, while Goldstein and St. Vincent were negotiating a new contract, the hospital hired Richard Gerety, a cardiac surgeon who immediately began performing peripheral vascular and thoracic procedures even though St. Vincent had assured Goldstein that Gerety would not do such cases.

u St. Vincent’s chief information officer Rick Crabtree, who took over negotiations from Frank, fired Goldstein on Jan. 26 and redirected his practice to Gerety even though Gerety is not a board-certified vascular surgeon.

The complaint seeks unspecified damages for breach of contract, fraudulent or negligent misrepresentation, wrongful termination and infliction of emotional distress. Named as defendants are St. Vincent, Frank, Crabtree and St. Vincent president Alex Valdez.
